TERMS OF SERVICE (EU & INTERNATIONAL)

These Terms of Service (hereinafter referred to as the "Agreement" or "Terms") govern your access to and use of the Site, as well as the purchase of any products through the Site by customers located in the European Union (EU), European Economic Area (EEA), and elsewhere outside the Americas.

If you are located in the European Union or any other served market outside of the Americas, your contract of sale is concluded exclusively with:

2. IMPORTANT HEALTH AND PRODUCT DISCLAIMER

The products sold on the Site are dietary supplements and are not intended as medicinal products or drugs.

  • Compliance: These products comply with all applicable EU food safety, manufacturing, and labeling regulations.

  • Usage: Dietary supplements are not intended as a substitute for a varied, balanced diet and a healthy lifestyle. Do not exceed the recommended daily dose.

  • Medical Consultation: We strongly recommend consulting a qualified healthcare professional before starting any supplement program, particularly if you are under 18, pregnant, nursing, taking prescription medications, or managing a chronic medical condition.

3. AGE RESTRICTIONS AND ACCOUNTS

By registering an account on the Site or completing a purchase, you confirm that you are at least 18 years old (or have reached the age of majority in your jurisdiction) and possess full legal capacity to enter into this binding Agreement. You are solely responsible for maintaining the confidentiality of your account credentials, login information, and passwords.

4. PRICES, PAYMENT, AND TAXES

  • All prices displayed on the Site are subject to change without prior notice.

  • Value Added Tax (VAT): For EU customers, prices displayed include VAT in accordance with applicable European tax legislation based on the country of destination.

  • Accuracy: You agree to provide current, complete, and accurate purchase and payment information for all orders. We reserve the right to refuse, restrict, or cancel any order at our sole discretion (e.g., in cases of suspected fraud, product stock unavailability, or obvious pricing errors).

5. SHIPPING AND DELIVERY

  • Fulfillment: Orders from customers in Europe and other international regions outside the Americas are fulfilled and dispatched from our European warehouse located in Gdańsk, Poland.

  • Delivery Timeframes: Estimated delivery dates provided on the Site are non-binding estimates only. We are not liable for transit delays caused by regional holidays, postal carrier issues, or force majeure events.

  • Import Customs and Duties: If an order is shipped to a country outside the European Union customs zone, the Buyer acts as the importer of record and assumes full legal and financial responsibility for paying all import duties, tariffs, VAT, and local customs clearance fees.

6. RETURNS, REFUNDS, AND RIGHT OF WITHDRAWAL

  • Right of Withdrawal: Under EU consumer protection laws, you have the right to cancel your purchase and return an item within 14 days of delivery without justification.

  • Health and Hygiene Exceptions: In accordance with statutory exceptions for sealed goods, opened or unsealed dietary supplements cannot be returned or refunded under any circumstances due to health protection and hygiene regulations. The protective seal and original packaging must remain fully intact.

  • Process: All return requests must be formally initiated by contacting return@fuel-up.com. Return shipping costs are borne entirely by the Buyer, unless the product arrived damaged or defective. Please review our full EU Refund Policy for detailed packing guidelines.

7. LIMITATION OF LIABILITY

To the maximum extent permitted under applicable Polish and European consumer law, Fuelup Factory Sp. z o.o. shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the Site or the misuse of dietary supplements purchased here. Our aggregate liability for any legal claim arising out of a purchase transaction shall not exceed the actual amount paid by you for the specific product in question.

8. INTELLECTUAL PROPERTY

All content featured on the Site (including texts, page designs, graphics, trademarks, source code, logos, and product imagery) is the exclusive intellectual property of the Fuel-Up brand and is protected by international copyright, trademark, and intellectual property laws. Any unauthorized duplication, copying, or commercial exploitation is strictly prohibited without prior written permission.

9. DISPUTE RESOLUTION AND JURISDICTION

Any disputes, controversies, or claims arising out of or relating to transactions handled by the European entity, Fuelup Factory Sp. z o.o., including the validity or termination of these Terms, shall be subject to the exclusive jurisdiction of the competent courts of Gdańsk, Poland.
